The Products are marketed under the brand Ormesini 1271, owned by ORMESINI1271 S.R.L. (hereinafter referred to as "the Seller", "we" or "our").
By placing an order on the Website, the User declares that they have read, understood and fully accepted these Terms and Conditions of Sale. Please read them carefully before making a purchase.
2. Definitions
"Website": the website www.ormesini1271.com, operated by ORMESINI1271 S.R.L. for the brand Ormesini 1271, through which the Products are sold.
"Products": the goods offered for sale on the Website, including candles, reed diffusers, room sprays, body fragrances, hand creams, body lotions, hair perfumes and shower gels.
"Customer" or "User": a natural person who makes purchases on the Website for purposes unrelated to any business, commercial, craft or professional activity they may carry out, pursuant to Article 3(1)(a) of Italian Legislative Decree 206/2005 (Consumer Code).
"Order": the purchase proposal submitted by the Customer through the Website.
"Order Confirmation": the email communication by which the Seller confirms acceptance of the Order and initiates its processing.
3. Scope of Application
These Terms and Conditions exclusively govern the distance sale of Products through the Website, pursuant to Italian Legislative Decree 206/2005 (Consumer Code) and Italian Legislative Decree 70/2003 (Electronic Commerce).
The submission of an Order implies full acceptance of these Terms, the Privacy Policy and the Cookie Policy published on the Website.
The Seller reserves the right to amend these Terms at any time. Amendments shall take effect from the date of publication on the Website and shall apply to Orders placed after such publication. The Website shall always display the most up-to-date version of the Terms and the relevant date of last update. It is the Customer's responsibility to periodically check the current version.
4. Eligibility to Purchase
To make purchases on the Website, you must be at least 18 years of age. Persons under 18 may browse the Website but may not make purchases independently; they must act through a parent or legal guardian.
The purchase of Products is reserved for consumers, defined as natural persons acting for purposes unrelated to their business, commercial, craft or professional activity, who hold a valid credit card, debit card or PayPal account.
5. Products
The Products offered for sale on the Website include: scented candles, reed diffusers, room sprays, body fragrances, hand creams, body lotions, hair perfumes and shower gels.
Each Product is accompanied by a product description outlining its main characteristics, including composition, size and ingredients (INCI). All Products sold on the Website comply with applicable cosmetics legislation (EU Regulation No. 1223/2009) and applicable product safety regulations.
The Products are intended exclusively for personal use. The Customer may not resell Products purchased on the Website. The Seller reserves the right, with or without prior notice, to refuse or cancel orders that, in its sole discretion, may constitute a breach of this prohibition.
6. Accuracy of Information on the Website
The Seller takes all reasonable professional care to ensure that the descriptions, images and details of the Products on the Website are accurate at the time of publication. However, no guarantee is given that the colours, information or other content available on the Website are in all cases accurate or complete.
Product images are for illustrative purposes only; packaging may vary from what is shown. As the colours actually displayed depend on the Customer's monitor and device settings, the Seller cannot guarantee that on-screen colours will accurately match the actual Product.
The Website may contain typographical errors or inaccuracies. The Seller therefore reserves the right to correct any errors, inaccuracies or omissions – including after the submission of an Order – and to update information at any time without prior notice. Such errors may also relate to prices and Product availability; in such cases, the Seller reserves the right to cancel orders based on incorrect information, after notifying the Customer.
7. Product Availability and Purchase Limits
The Products offered for sale are those displayed on the Website at the time of browsing, subject to stock availability. The Seller undertakes to indicate any Product unavailability on the Website; however, due to the nature of electronic commerce, a Product may become unavailable after an Order has been submitted.
In the event of total or partial unavailability of an ordered Product, the Customer shall be promptly notified by email and any amounts charged shall be fully refunded.
The Seller reserves the right to limit the maximum quantities that may be purchased per Product or per order, in order to ensure fair distribution to all Customers and prevent purchases for resale purposes.
8. Purchase Procedure
To make a purchase, the Customer selects the desired Products, adds them to the shopping cart and proceeds to checkout by completing the required shipping and billing information. Before confirming the Order, the Customer has the opportunity to review and correct the data entered, modify the contents of the cart, add or remove Products, and choose the payment and shipping method.
The Order is submitted by clicking the confirmation button, with an obligation to pay pursuant to Article 51(2) of the Consumer Code. The submission of the Order constitutes, under applicable electronic signature legislation, proof of the Order itself and the amount due.
After the submission of the Order, the Customer will receive an acknowledgement email with the Order summary and reference number. This email does not constitute acceptance of the Order. The contract between the Customer and the Seller is concluded upon dispatch of the Order Confirmation (shipping confirmation email) or, in any event, upon shipment of the Products.
The Seller reserves the right not to accept an Order for the following reasons: unavailability of Products, errors in price or information, inability to process payment, inability to deliver to the address provided, duplicate orders, or other reasonable circumstances. In such cases, the Customer shall be promptly notified by email and any amounts already charged shall be refunded.
9. Order Processing and Tracking
Orders are processed within 1 business day from payment confirmation and shall in any event be delivered within 30 days from the Order Confirmation. If delivery does not take place within this period, the Customer has the right to set an additional reasonable deadline. If delivery does not occur within the additional deadline, the Customer may terminate the contract and obtain a full refund within 14 days of termination.
If the Customer has an account on the Website, they may check the status of their orders at any time from the Orders section of their profile or via the Track My Order page. Once the Order has been shipped, the Customer will receive a shipping confirmation email with a tracking number and a direct link to follow the delivery in real time.
Orders may occasionally be cancelled in whole or in part by the Seller for legitimate reasons, including: items out of stock, inability to process payment, inability to deliver to the address provided, duplicate orders or cancellation at the Customer's explicit request. In the event of cancellation, the Customer will receive an email with the reason and a refund of any amounts charged.
10. Prices
Product prices are expressed in Euros (€) and are inclusive of VAT and all other applicable taxes. Shipping costs, where applicable, are indicated separately during the checkout process and before Order confirmation.
The Seller reserves the right to change prices at any time without prior notice. The price applied shall be the one indicated on the Website at the time the Order is submitted. Price accuracy is regularly verified; in the event of a manifest error, the Seller will contact the Customer to offer the option of purchasing the Product at the correct price or cancelling the Order.
11. Payment Methods
Payment may be made by the following methods:
Credit or debit card – Visa, Mastercard and any other supported networks. Card payments are processed through Stripe, a PCI DSS certified platform, which ensures the highest security in data transmission. Online payment uses SSL/TLS protocol; card data is neither stored nor viewed by the Seller.
PayPal – payment is processed through the Customer's PayPal account. The Customer will be redirected to the PayPal platform to authorise the transaction.
Payment will be authorised at checkout; the actual charge will be applied at the time of shipment. No Order can be fulfilled without confirmation of successful payment.
The Customer confirms that the credit card or PayPal account used is in their own name. All cardholders are subject to validation and authorisation checks by the issuing institution. In the event of payment authorisation failure, the Order cannot be processed and the Seller shall not be liable for any delays or non-deliveries.
By placing an Order, the Customer expressly authorises the Seller to transmit or receive information from third parties, including the payment card number, exclusively for the purposes of identity authentication, card validation and transaction authorisation.
Confirmation of the amount paid will be included in the Order Confirmation email and in the invoice enclosed with the package.
12. Shipping and Delivery
We currently ship to Italy and all European Union member states. All orders are dispatched from our facilities in Italy.

Shipping costs are clearly displayed at checkout before the Customer confirms the Order. No additional fees or surcharges will be applied after purchase.
Estimated delivery times are 2–6 business days for Italy and 4–9 business days for the European Union, calculated from the date of dispatch. Delivery times are provided for guidance only; occasional delays may occur due to carrier operations, customs procedures or circumstances beyond our control. In any event, all orders will be delivered within 30 days from the Order Confirmation, in accordance with the Italian Consumer Code (D.Lgs. 206/2005). The Customer's rights under Articles 61 et seq. of the Consumer Code are fully preserved, including the right to set an additional deadline and to terminate the contract in the event of non-delivery.
All shipments are managed through our shipping platform, which selects the best available carrier for each destination. Depending on the delivery location, the order may be delivered by BRT/Bartolini, GLS, Poste Italiane/SDA, DHL, DPD, PostNL, Colissimo, Correos, or other national postal services.
Products are shipped to the address indicated by the Customer at the time of the Order. Once the Order has been placed, the shipping address cannot be changed. It is the Customer's responsibility to ensure that the shipping address provided is complete and accurate, including house number, apartment, floor and any other necessary details. The Seller is not liable for delays or failed deliveries caused by incorrect or incomplete information.
Deliveries to P.O. Boxes are not available.
Tracked shipments that cannot be delivered due to the recipient's absence will follow the carrier's standard re-delivery procedures. Parcels that remain uncollected may be returned to us at the Customer's expense.
Upon delivery, the Customer is required to check the integrity of the packaging and that the correct number of parcels has been received. In the event of visible damage, the Customer must accept delivery with a written reservation and promptly report the matter to the Seller.
The risk of loss or damage to the Products passes to the Customer at the time when the Customer, or a third party designated by the Customer other than the carrier, physically takes possession of the Products, pursuant to Article 63 of the Consumer Code.
Products containing alcohol (fragrances, room sprays) may be classified as restricted goods under ADR/IATA international transport regulations. Shipments to certain destinations may be subject to restrictions or require specific transport methods. If it is not possible to ship to the requested destination, the Customer will be notified and refunded.

13. Right of Withdrawal, Returns and Exchanges
Pursuant to Articles 52–59 of the Consumer Code, the Customer has the right to withdraw from the contract, without giving any reason, within 14 days of receiving the Products. To exercise this right, the Customer must request a return by logging into their account on the Website, going to "My orders" and clicking "Request return", or by writing to customer@ormesini1271.com. Once the return has been requested, the Customer has a further 14 days to ship the parcel. Return shipping is free of charge.
In addition to the legal right of withdrawal, the Seller offers the Ormesini 1271 Satisfaction Guarantee, which allows Customers to return Products that have been opened to try, provided the applicable conditions are met (e.g. candle wicks have not been lit, body fragrances contain at least 90% of original content, diffuser reeds have not been inserted). Full details are set out in the Return & Refund Policy.
The Customer may also request an exchange for a different product (for example, a different fragrance or format) within the same 14-day return window and under the same conditions as the Satisfaction Guarantee. To request an exchange, please contact customer@ormesini1271.com.
The following items are classified as final sale and cannot be returned or exchanged: gift vouchers and gift cards.
After receiving and verifying the return, the Seller will process a full refund to the Customer's original payment method within 14 days. No restocking fees apply. Alternatively, the Customer may request a refund as Ormesini Credit to their account on the Website.
Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded for sealed products which are not suitable for return for hygienic reasons or reasons connected with health protection and which have been opened after delivery, beyond the limits permitted by the Satisfaction Guarantee.
The provisions of this section do not limit the applicability of mandatory consumer protection rules in force in the Customer's country of residence. For full details, please refer to our Return & Refund Policy.
14. Legal Guarantee of Conformity
All Products sold on the Website are covered by the legal guarantee of conformity provided for by Articles 128–135 of the Consumer Code. The Seller is liable to the Customer for any lack of conformity existing at the time of delivery and which becomes apparent within 2 (two) years of delivery.
The Customer must report the lack of conformity within 2 (two) months of discovery. In the event of a confirmed defect, the Customer is entitled to repair or replacement of the Product or, where this is not possible or disproportionately costly, to a price reduction or termination of the contract, in accordance with applicable law.
The guarantee does not apply in the case of damage resulting from improper use of the Product, Customer negligence or external factors not attributable to the Seller.
If a Product is delivered damaged or is found to be defective, please contact us within 14 days of receiving the product at the contact details indicated in Section 1, quoting the order number.
15. Limited Use Licence and Website Restrictions
The Seller grants the Customer a limited, revocable, non-transferable and non-exclusive licence to access and use the Website exclusively for personal and non-commercial use. This licence does not include the right to:
- use framing techniques to incorporate the Website or portions thereof into other websites;
- use meta tags, "hidden text", robots, spiders, crawlers or other manual or automated tools to collect, extract, index, republish, redistribute, transmit, sell, license or download the Website and/or its content;
- use the Website and/or its content for purposes other than personal use;
- modify, decompile, disassemble, reverse engineer or create derivative works based on the Website or its content;
- collect information relating to other users' accounts;
- impersonate other persons or entities, or falsely state their affiliation with persons or entities;
- use robot software, spiders, crawlers or similar tools, or take actions that may impose an excessive load on the Website's infrastructure;
- transmit, upload or distribute viruses, malware, worms or any other destructive code or material intended to disrupt, alter or damage the operation of the Website;
- make or send unsolicited or unauthorised commercial communications, including email chains, mass mailings or any form of spam.
Any unauthorised use of the Website results in the automatic revocation of this licence, without prejudice to any other remedy provided by law or these Terms.
16. User Obligations and Liability
In accessing and using the Website, the Customer undertakes to comply with these Terms and to act in accordance with the law and in good faith.
The Customer must not: (i) make modifications to the Website or its content; (ii) compromise in any way the integrity or operation of the Website; (iii) use the Products for illegal or unauthorised purposes; (iv) violate, in using the Website, any law in force in their jurisdiction, including intellectual property laws.
A breach of these Terms may result in the immediate termination of access to the Website and the services offered.
The Customer is liable for any damage caused to the Seller, its affiliated companies or its partners as a result of a wilful or negligent breach of the obligations set out in these Terms.
17. Limitation of Liability
The Seller is not liable for any damage resulting from improper use of the Products. The Customer is advised to carefully read the list of ingredients (INCI) on the packaging to check for the possible presence of allergens or substances to which the Customer may be sensitive.
Candles and diffusers must be used in accordance with the instructions on the label or packaging. The Seller disclaims any liability for damage to property or persons resulting from misuse or failure to follow the instructions.
The Seller is liable to the Customer for losses and damages that are a reasonably foreseeable consequence of a breach of contract or the Seller's failure to exercise reasonable care.
The Seller is not liable for delays or failures to perform arising from force majeure or events beyond its reasonable control.

18. Website Availability and Disclaimer
Access to the Website is provided on a temporary basis. The Seller reserves the right to modify, suspend or discontinue, temporarily or permanently, the Website (or any part thereof) at any time and without prior notice. The Seller shall not be liable to the Customer if the Website is unavailable, in whole or in part, at any time or for any period.
The Seller does not guarantee that the Website is free from errors, omissions, viruses or other harmful components, or that its operation is uninterrupted or free from defects. The Website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by applicable law.
The Customer acknowledges that information transmitted through the Website may pass through unencrypted networks and may be adapted to conform to the technical requirements of connecting networks or devices.
19. Intellectual Property
All content on the Website – including text, images, photographs, graphics, logos, trademarks (including the Ormesini 1271 trademark), domain names, software, the overall look and feel and any other material – is the property of ORMESINI1271 S.R.L. or the respective rights holders and is protected by Italian, European and international intellectual and industrial property laws.
The Seller's trademarks and corporate identity may not be used in any manner or for any purpose without the Seller's prior written consent.
Any reproduction, distribution, modification, use or exploitation of the content of the Website, in whole or in part, without the Seller's written authorisation is prohibited.
20. User Account
The Customer may browse and purchase on the Website without the need to register. However, creating an account provides access to additional features, such as order tracking, delivery status via the Track My Order page, and personal data management.
Upon registration, the Customer is responsible for ensuring that the personal data provided is truthful, accurate and kept up to date, as well as for maintaining the confidentiality of their login credentials. In the event of unauthorised use of the account or password, the Customer must promptly notify the Seller.
The Customer accepts responsibility for all activities carried out through their account.
The Seller reserves the right to suspend, deactivate or delete an account in the event of a breach of these Terms or if it deems it appropriate in its reasonable discretion. The Customer may at any time request the deletion of their account by contacting the Seller at the contact details indicated in Section 1.
21. Personal Data Protection
The processing of the Customer's personal data is carried out in compliance with Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree 196/2003 (Privacy Code) as amended by Italian Legislative Decree 101/2018.
For all information regarding the methods of collection, use and protection of personal data, please refer to the Privacy Policy and Cookie Policy available in the dedicated sections of the Website. By proceeding with the purchase, the Customer declares that they have read these documents.
22. Links to Third-Party Websites
The Website may contain links to third-party websites. Such links are provided solely for the Customer's convenience and do not imply any endorsement, association or guarantee by the Seller regarding the content, products or services offered by such websites. The Seller is not responsible for reviewing or assessing such websites, nor for their actions, content, products, services, privacy policies or terms and conditions. The Customer is advised to carefully consult the terms of use and privacy policies of any third-party websites visited.

The Seller undertakes to respond to every complaint as soon as possible and in any event within 30 days of receipt.
24. Alternative Dispute Resolution (ADR/ODR)
Pursuant to Article 141-sexies(3) of the Consumer Code, the Seller informs the Customer that, should a complaint submitted directly to the Seller not have a satisfactory outcome, the Customer may use the alternative dispute resolution (ADR) procedures provided for by applicable legislation.

25. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
For any dispute arising from the interpretation, performance or termination of these Terms, exclusive jurisdiction shall lie with the court of the place of residence or domicile of the consumer Customer, pursuant to Article 66-bis of the Consumer Code. For Customers who do not qualify as consumers, the Court of Vicenza shall have exclusive jurisdiction.
26. Assignment of Rights
The Seller may transfer its rights and obligations arising from these Terms to an affiliated company or another organisation, giving written notice to the Customer. Such transfer shall not affect the Customer's rights or the Seller's obligations under these Terms.
The Customer may not transfer to third parties their rights or obligations arising from these Terms without the Seller's prior written consent.
27. Final Provisions
If any clause of these Terms is found to be invalid or unenforceable, this shall not affect the validity of the remaining clauses, which shall remain fully valid and effective.
The Seller's failure to exercise a right provided for by these Terms shall not constitute a waiver of such right.
These Terms and Conditions, together with the Privacy Policy, Cookie Policy and Return Policy, constitute the entire agreement between the Customer and the Seller in relation to the use of the Website and the purchase of Products, and supersede any prior understanding or agreement, whether written or oral.
